AniSurge is an anime tracking and identity platform. It allows you to log anime you have watched, rate and review titles, build a public identity profile, earn achievements, track stats, and discover what others in the community are watching.

AniSurge is currently in open beta and is provided free of charge. Features, limits, and availability may change during the beta period. We will provide reasonable notice of material changes where possible.

You must meet the following requirements to use AniSurge:

• You must be at least 13 years of age
• If you are located in India, you must be at least 18 years of age, or have verifiable parental consent as required under India's DPDP Act 2023
• You must have the legal capacity to enter into a binding agreement in your jurisdiction
• You must not be previously banned from AniSurge

By creating an account, you confirm that you meet these requirements. If we become aware that you do not, we may suspend or delete your account.

You are responsible for:

• Providing accurate and truthful information when creating your account
• Maintaining the security and confidentiality of your password
• All activity that occurs under your account, whether authorised by you or not
• Choosing a username that does not impersonate another person, brand, or entity
• Notifying us immediately at anisurge.team@gmail.com if you suspect unauthorised access to your account

We are not liable for loss or damage arising from your failure to keep your account credentials secure.

AniSurge allows you to create content including reviews, ratings, profile bios, quotes, and other text and images ("User Content"). You retain full ownership of your User Content.

By submitting User Content to AniSurge, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to store, display, and distribute that content as part of operating the AniSurge platform. This licence terminates when you delete the content or your account.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• Your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
• Your User Content complies with these Terms and applicable law

You agree not to submit User Content that:

• Is defamatory, harassing, threatening, intimidating, or abusive toward any person
• Incites hatred, discrimination, or violence on the basis of race, ethnicity, religion, gender, sexual orientation, disability, nationality, or any other protected characteristic
• Contains sexually explicit material
• Infringes the intellectual property, trademark, or copyright of any third party
• Contains malware, phishing links, spam, or deceptive content
• Impersonates any person, entity, or AniSurge itself
• Discloses private information about another person without their consent ("doxxing")
• Violates any applicable law or regulation

You agree not to use AniSurge to:

• Scrape, crawl, mirror, or systematically extract data without our prior written permission
• Attempt to access, probe, or test the security of our systems without authorisation
• Circumvent, disable, or interfere with security features of the platform
• Use automated tools (bots, scripts) to create accounts, generate content, or manipulate platform metrics
• Send unsolicited messages or spam to other users
• Reverse engineer, decompile, or attempt to derive the source code of AniSurge
• Use AniSurge in any way that violates applicable law in your jurisdiction or ours

Anime titles, cover images, banner images, episode counts, scores, descriptions, tags, and related metadata displayed on AniSurge are sourced from the AniList GraphQL API (anilist.co). AniSurge uses the AniList API in accordance with AniList's Terms of Use (docs.anilist.co/guide/terms-of-use). AniSurge is not affiliated with, endorsed by, or officially connected to AniList.

Cover images, banner images, and other visual artwork displayed on AniSurge are served directly from AniList's content delivery network (CDN). This artwork remains the exclusive property of the respective copyright holders — including but not limited to anime studios, production companies, distributors, and licensors. AniSurge does not claim ownership of, reproduce, or distribute this artwork. All rights are reserved by the respective copyright holders.

AniSurge does not store anime cover images, banner images, or other third-party copyrighted artwork on its own servers. All such content is fetched and served in real time from AniList's infrastructure. If you are a rights holder and believe content is being displayed in a way that infringes your rights, please contact us at anisurge.team@gmail.com and we will address your concern promptly.

AniSurge metadata attributions: anime titles, scores, descriptions, and character data © their respective copyright holders. Metadata structure and API access provided by AniList (anilist.co).

AniSurge intellectual property

The AniSurge name, logo, visual design, user interface, original code, engagement systems (XP, achievements, rank system, personality type algorithm), and all original content created by AniSurge are the exclusive intellectual property of the AniSurge operator and are protected under applicable copyright, trademark, and intellectual property laws.

You may not reproduce, copy, modify, distribute, sell, or create derivative works from any AniSurge original content — including the logo, design system, achievement system design, or codebase — without our prior written permission.

Feedback, suggestions, or ideas you submit to us may be used by AniSurge without obligation or compensation to you, unless otherwise agreed in writing.

We reserve the right — but are not obligated — to review, moderate, or remove User Content that we believe violates these Terms, at our sole discretion and without prior notice.

We reserve the right to:

• Remove any User Content that violates these Terms
• Issue warnings, restrict features, suspend, or permanently terminate accounts that violate these Terms or engage in behaviour harmful to users or the platform
• Report illegal content or activity to law enforcement where required or appropriate

When taking enforcement action, we will consider the severity and nature of the violation. Serious or repeated violations (harassment, illegal content, systematic abuse) may result in immediate permanent termination without warning.

You may appeal enforcement decisions by contacting anisurge.team@gmail.com.

You may delete your account at any time by contacting anisurge.team@gmail.com. Upon receiving your request, we will:

• Confirm receipt within 5 business days
• Permanently delete your account and all associated personal data within 30 days
• Send a confirmation email when deletion is complete

Certain anonymised or aggregated data (such as aggregate platform statistics) may be retained after account deletion as it cannot be attributed to you individually.

AniSurge is currently free. We plan to introduce optional paid features ("Pro") in a future update. When we do:

• Payments will be processed by Stripe, Inc. AniSurge will not store your full card details. Stripe's Terms of Service and Privacy Policy will govern payment processing.
• Subscriptions will be charged on a recurring basis (monthly or annual, as selected) until cancelled
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• Refunds will be handled in accordance with our refund policy, which we will publish before launch
• Prices will be displayed in Australian Dollars (AUD) and may vary by region due to currency conversion

This section will be updated with full detail when paid features launch.

AniSurge is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

As a beta product operated by a solo developer, downtime, bugs, and data inconsistencies may occur. We will make reasonable efforts to maintain availability but do not guarantee uninterrupted service.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot lawfully be excluded by agreement. To the extent permitted by the ACL, our liability for breach of a consumer guarantee applicable to a service is limited to resupplying the service or paying the cost of having the service resupplied.

EU/UK users: Nothing in these Terms affects your statutory rights as a consumer under applicable EU or UK law.

To the maximum extent permitted by applicable law, AniSurge and its operator shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from or relating to your use of AniSurge, including but not limited to loss of data, loss of profits, or service interruption, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from your use of AniSurge shall not exceed the greater of: (a) the total amount you have paid us in the twelve months preceding the claim; or (b) AUD $100.

Nothing in this section limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be limited by law in your jurisdiction.

You agree to indemnify, defend, and hold harmless AniSurge and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or relating to: your use of AniSurge; your User Content; your violation of these Terms; or your violation of any third party's rights.

These Terms are governed by the laws of Western Australia, Australia, without regard to its conflict of law principles.

For users located outside Australia: nothing in these Terms prevents you from relying on the mandatory consumer protection laws of your country of residence that cannot be excluded by contract. For EU/UK users, you may bring proceedings in the courts of your country of residence.

We encourage you to contact us at anisurge.team@gmail.com in the first instance to resolve any dispute informally. We will make good-faith efforts to resolve disputes without formal legal proceedings.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page.

For material changes, we will notify you via the email address associated with your account at least 14 days before the changes take effect, where reasonably practicable. Your continued use of AniSurge after updated Terms take effect constitutes your acceptance of the changes.

If you do not agree to material changes, you may delete your account before they take effect.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy (anisurge.com/privacy), constitute the entire agreement between you and AniSurge regarding your use of the service, and supersede any prior agreements.
